VeryGeek Design Products and Services Terms and Conditions

By becoming a customer of VeryGeek Design, you agree that you have read, understood, and agreed with the following Terms and Conditions, and irrevocable consent to be bound by all said Terms and Conditions, including any updates thereto. VeryGeek Design has the right to change the Terms and Conditions, in whole or in part, at any time with or without notice. Please print these Terms and Conditions for your records.

Any reference made in these Terms and Conditions to products and services provided by VeryGeek shall include, but not be limited to, all graphic design and web design, including logos, web sites, business cards, brochures and any future products or services offered. Please ensure that the email address you provide can receive emails from VeryGeek

Satisfaction Guarantee
All work is completed according to the design brief submitted by you and/or your client/s and any information submitted by email. You are entitled to free revisions, up to four free revisions for our basic logo package, and up to 6 for our premium logo package. Our Satisfaction guarantee entitles you to a completely new set of concepts (one free redraw) if you are not satisfied with your initial concepts. If you request a redraw or revisions, please provide as much feedback as possible as VeryGeek is not obliged to provide revisions further to the number of revisions stated for any particular product/service. Revisions or redraws must be requested within 5 calendar days. After 5 calendar days it will be assumed that you are satisfied and the project is complete. Once a project is stated as complete, working files will be kept for no longer than 7 calendar days. After this time, VeryGeek has no obligation to keep any files and such files may be removed entirely. Additional charges may be added if it is necessary to re create files after this time. Once finals have been requested/received no further changes can be made and an additional charge of £25 is applicable for any amendments required to finals after they have been requested and/or received.

Ownership/Copyright
After approving the final design, ownership of the artwork becomes yours. VeryGeek is entitled to only use the artwork for VeryGeek’s portfolio or the protfolio’s of it’s resellers, extending to the use of your logo on promotional materials published by VeryGeek to promote VeryGeek’s own products and services. All concepts are the property of VeryGeek, including any concepts not chosen for finals. Any legal issue arising through the use of your logo after you have received finals is not the responsibility of VeryGeek.
Trademarks and Service Marks VeryGeek shall have no obligation or duty to perform trademark, service mark or copyright searches or inquiries, or the like, in order to validate the propriety or legality of the Final Design. No trademarks or service marks in or to any Final Design are being conveyed under these Terms and Conditions. Ideas and Materials Provided by Customer Any idea or material, including but not limited to, images, photographs, graphics, composites, sketches, drawings, text and illustrations supplied by you for inclusion, incorporation and/or addition into the design are your property, and you warrant that you have taken the necessary steps to acquire the permission of the legal copyright and/or trademark holder for the use thereof. You agree to indemnify VeryGeek in the case that the supplied materials are found to be infringing on the copyright, trademark or intellectual property claims of the legal owner of this material

Logo Refund Policy
VeryGeek is committed to do our best to meet and exceed your expectation. You are entitled to a refund less an administration fee of £20 under the following conditions: You have requested the refund within 3 days of our sending the initial design concepts to you to review and have not given us instructions to redraw or to continue to work on revisions of the initial design concepts that have been sent to you.

Other Services Refund Policy
All other service orders are Final. We do not under any circumstance offer any refunds on other services provided by VeryGeek due to the excessive time that is spent by us designing & or developing these other services which include but are not limited to web design, banner design, business card design, stationary design, flyer design, brochure design and any other service. We provide our customers with every reasonable measure to ensure satisfaction, however, our refund policy is All Sales Are Final.

You agree to provide timely responses to any status notifications that VeryGeek sends you. You shall have 5 calendar days to respond to each response sent to you. If you have failed to respond after 5 calendar days, VeryGeek will assume that your project is complete and the project shall be deemed completed. At such time, VeryGeek will have no further obligation to you. VeryGeek reserves the right, in its sole discretion, not to guarantee your access to all or a portion of the Service, at any time, with or without notice and will determine, in its sole discretion, whether you are entitled to any refund. Should you receive a refund, you agree that your acceptance of the refund shall constitute your sole and exclusive remedy with respect to related Responses. Additionally, you acknowledge and agree that you will have no right (express or implied) to use any design concept, artwork, content, or media developed on your behalf by VeryGeek, nor will you have any ownership interest in or to the same

Order Acceptance and Cancellation
VeryGeek retains the right in its sole discretion, to refuse and refund any projects or content that is explicitly adult in nature, or deemed inappropriate by VeryGeek. We shall have the right (but not the obligation) to pre-screen, refuse or remove any project and/or user provided content that violates these Terms and Conditions or is otherwise objectionable, including, without limitation, projects or content that is illegal, obscene, indecent, and defamatory; incites religious, racial or ethnic hatred; or violates the rights of others. We reserve the right after acceptance of your order to cancel, terminate, or otherwise cease work on your order for any reason and at any time without notice, whether or not your credit card has been charged or if payment has otherwise been received by us.

Electronic Communications
When you become a Customer of VeryGeek you consent to receive, via email or otherwise, status notifications, a newsletter, and carefully selected special offers and promotions for certain products and services that could be of value to you. We will communicate with you by emails and by posting information or notices via the VeryGeek Web site. You agree that all agreements, notices, disclosures and other communications that VeryGeek provides to you electronically satisfy any legal requirement that such communications be in writing.

Indemnification
You agree to indemnify and hold VeryGeek harmless against any and all claims, demands, regulatory proceedings, and all damages, costs (including, without limitation, settlement costs), and expenses of any kind whatsoever (including, without limitation, reasonable attorneys fees) directly or indirectly arising from or relating to our agreement or VeryGeek provision of products or services to you including, but not limited to, (i) you use or misuse of any product or service supplied by us or third parties through us approved by you or any materials or information supplied by you; (ii) any products, services or activities undertaken by VeryGeek on your behalf; or (iii) your sale of its products and services or other operation of its business. Legal Disputes You hereby agree and consent to venue in Toronto, Ontario, Canada in the event of any legal action regarding these Terms and Conditions or of any copyright enforcement issues.
